NEW AFFIRMATIVE ASYLUM INTERVIEW SCHEDULING
Starting January 29, 2018, the Asylum Division will give priority to the most recently filed affirmative asylum applications when scheduling asylum interviews.
USCIS’ predecessor, the Immigration and Naturalization Service, first established this interview scheduling approach as part of asylum reforms implemented in January 1995. This approach was in place until December 2014. The aim is to deter individuals from using asylum backlogs solely to obtain employment authorization by filing frivolous, fraudulent or otherwise non-meritorious asylum applications.
Giving priority to recent filings allows USCIS to promptly place such individuals into removal proceedings, which reduces the incentive to file for asylum solely to obtain employment authorization. This approach also allows USCIS to decide qualified applications in a more efficient manner.
USCIS will now schedule asylum interviews in the following order of priority:
• First priority: Applications that were scheduled for an interview, but the interview had to be rescheduled at the applicant’s request or the needs of USCIS.
• Second priority: Applications that have been pending 21 days or less.
• Third priority: All other pending affirmative asylum applications will be scheduled for interviews starting with newer filings and working back towards older filings.

NEW ENTREPRENEUR PAROLE PROGRAM
U.S. Citizenship and Immigration Services (USCIS) has recently announced that it will accept applications for the new Entrepreneur Parole program where entrepreneurs and their families will be able to come to the U.S. for up to 5 years, in two, 30-month increments, based on an investment of $375,000.
EB-5 VISA PROGRAM HAS BEEN EXTENDED
On December 21, 2017, U.S. lawmakers avoided a government shutdown by passing a temporary budget extension through January 19, 2017. This extension includes the EB-5 visa program.
USCIS IS NOT CONSIDERING CHANGES TO H-1B EXTENSION RULES
USCIS has recently stated that the agency is not considering changing its interpretation of section 104(c) of the American Competitiveness in the Twenty-First Century Act (AC21), which provides for H-1B extensions beyond the six-year limit for H-1B workers who have reached certain milestones in their green card process.
VISA BULLETIN FOR FEBRUARY 2018 HAS BEEN PUBLISHED
The employment-based, first preference (EB-1), second preference (EB-2) and third preference (EB-3) category remains current for all countries of changeability except those listed. (Please revisit visa bulletin for cut off dates for those countries).
The priority dates for 2018 Dv lottery winners from Europe (including Turkish applicants) will be at 13800.
