E-2 Employee Status

     An E-2 status holder can petition to bring an employee from their treaty country to develop the business enterprise in the United States. The requirements for an E-2 Employee Status are:

     – The employer must be a nationality of the treaty country and own at least 50% of the U.S. business.

     – Both employer and employee must possess the same nationality.

     – The employer must maintain E status in the U.S. unless residing outside of the U.S.

 

     After making sure these requirements are met, you should consider what type of employee you will be bringing from the treaty country. There are two options which differ in responsibilities:

     – An employee who will have executive/ supervisory responsibilities;

     – An employee who has a specialized skill that is “essential” to the operating of the business. (For example: Cook with specific skills in a certain cuisine such as Turkish,Italian, French, etc.)

Furthermore, the employer can later sponsor the E-2 employee to obtain permanent residency (i.e. green card).

E-2 Calisan Statusu

     E-2 statusune sahip kisi, sirketi vasitasi ile ticari girisimine yardimci olmak icin kendi ulkesinden Amerika Birlesik Devletlerine calisan getirme talebinde bulunabilir. E-2 Calisan Statusunun kosullari su sekildedir:

     – Isveren kisinin vatandas oldugu ulke ABD ile E-2 anlasmasi olan bir ulke olmalidir ve bu kisinin Amerika’daki sirketin en az %50’sine sahip olmasi gereklidir.

     – Isveren ve calisanin ayni ulkenin vatandaslari olmalari gerekmektedir.

     – Isveren Amerikada yasiyorsa E statusunde olmasi gerekir.

 

     Bu kosullarin karsilandigindan emin olunduktan sonra, anlasmali ulkeden ne tur bir calisan getirmek istediginizi dusunmelisiniz. Iki secenek arasindaki farklilik, alinan sorumluluklardan kaynakanmaktadir:

     – Idari veya yonetici sorumluluklara sahip bir calisan getirilebilir;

     – Sirketinizin ozel kabiliyet veya yetenege “gereksinimi” olabilir. (Ornegin: Turk, Italyan, Fransiz, mutfagi gibi belirli mutfak kulturune hakimiyeti olan bir asci)

 

     Ayrica, isveren sirket sonrasinde E-2 calisana oturma izni (green card) basvurusu icin sponsor olabilmektedir.
