LEAVING THE U.S. WITH A TRAVEL DOCUMENT
LEAVING THE U.S. WITH A TRAVEL DOCUMENT
Permanent residents (Green Card), refugees, asylees, and other aliens can benefit from Form I-131, Application for Travel Document. There are three types of travel documents that can be applied for:
- Reentry Permit
- Refugee Travel Document
- Advanced Parole (2 kinds)
GREEN CARD HOLDERS
Lawful Permanent Residents can apply for Reentry Permits which you apply for and receive in the U.S. but can also have the permit sent to a U.S. Embassy or Consulate abroad. If you leave the country after having obtained a Reentry Permit, you will not be abandoning your status as long as the Reentry Permit is valid and you are not outside of the United States for more than a year. A Reentry Permit is generally valid for 2 years and cannot be extended. Please note that if you had obtained your Green Card based on granted Asylum and visit the country where you feared persecution, you might be asked why you went to that country and how were you able to return safely. In some cases, you may be subjected to proceedings to terminate your asylum status and permanent residence at the same time.
REFUGEES AND ASYLEES
Once your asylum application is approved by the USCIS, you are considered an asylee. As an asylee you have the right to travel outside the United States with a travel document. Form I-131, Refugee Travel Document is used to get permission to re-enter United states after traveling abroad. Your approved Refugee Travel document is like your passport. It is valid for one year. This document will allow you to re-enter Unites States after traveling. However, a Refugee Travel Document does not guarantee being admitted into the United States. You will have to undergo inspection by an immigration Officer and there is the risk of not being re-admitted. Even though you need to have your travel document before traveling, in certain cases, you can apply for this document within that country.
Although you may be able to obtain a travel document, it does not necessarily mean that you should apply for one. For further information and guidance, contact Caglar Law Firm P.C.
