Can I Bring My Family Abroad into the U.S. With an Asylee Status?

If you reside in the United States as a refugee, or an asylee (approved asylum), you may file a form I-730 Refugee/Asylee Relative Petition to bring your family from abroad.

There are several conditions, though. You may only bring your wife, and unmarried children under 21 at the time you were granted asylum. You also must file your form I-730 within two years of your asylum grant, or your application might get rejected. You also are required to be the main applicant of your asylum application to qualify for a relative petition.

After you submit your application, the next step is for USCIS to approve it. After USCIS approves it, they send your application to your family’s country’s corresponding NVC. At this point, NVC will forward your case to your countries consulate, from where your family will receive an interview notice which they are required to attend.

If the interview goes well, and your application is approved, your family members will be given an entry visa to the US and be added to your asylum application as beneficiaries.
