Eger size verilen vize surenizi astiysaniz, buyuk ihtimalle Amerika’da “yasadisi mevcudiyet” gunleri biriktiriyor olabilirsiniz. Eger turist vizenizin sona erme tarihinden fazla kaldiysaniz veya ogrenci vizesi alarak okudugunuz okulun derslerini bitirdikten sonra kalmaya devam ettiyseniz, su anda statu disinda olabilirsiniz. Eger Amerika Birlesik Devletleri icersinde 180 gun ile 365 gun yasadisi mevcut bulunduysaniz, Amerikadan cikisinizdan sonraki 3 yil geri gelmekten men edilebilirsiniz. Eger Amerikada bir seneden fazla yasadisi kaldiysaniz, 10 yil men edilebilirsiniz.

Fakat, yasadisi mevcudiyet biriktirmeye dair bazi istisnai durumlar bulunmaktadir:

Resit olmayanlar: 18 yas altinda olanlar yasadisi mevcudiyette sayilmazlar.

Siginmacilar: Siginma basvurusunda bulunanlar, bu surec icersinde yasadisi calismadiklari surece, statu disinda sayilmazlar.

Darp edilmis kadinlar veya cocuklar, ya da insan kacakciligina maruz kalmis olanlar icin de yine istisnai durumlar soz konusudur.

Overstaying a Visa

If you have overstayed your visa, you are most likely accruing “unlawful presence” in the United States. If you overstay the expiration date of your tourist visa or you have completed the coursework of the U.S. school you studied at with a student visa, you may currently be out of status. If you are unlawfully present in the United States for between 180 and 365 days, you may be barred from entry into the U.S. for 3 years after your departure or removal. If you have been in the United States unlawfully for over a year, you could be barred for 10 years.

However, there are some exceptions to who can accrue unlawful presence:

Minors: Those under 18 years of age cannot accrue unlawful presence.

Asylees: Asylum applicants are not considered out of status as long as the applicant is not working without work authorization.

Battered women and children as well as victims of human trafficking are also exceptions to these rules.
