What is ‘Public Charge’ and Who Does it Apply to?

‘Public Charge‘ refers to an individual who is or will become dependent on the government for sustenance. If an individual is found to be a public charge, their Adjustment of Status (I-485) application for a Green Card will be denied unless they are refugees, asylees, individuals possessing U or T visas, or are of another exempt status.

The recent changes to definitions and standards in determining publıc charge does not change those exempted by congress but merely narrows down what immigration officers should consider and what the procedure should be for establishing a publıc charge determination.

‘Public Charge’ Nedir ve Kimin Için Geçerlidir?

Şu anda veya gelecekte devlet yardımına muhtaç olan veya olacak kişiye ‘Public Charge‘ denilir. Eger bir kişinin publıc charge oldugu kanaatine varılırsa ve multeci, sığınmacı, U veya T vizesine sahip kişi veya başka istisnai kategoriye sahip değilse o kişinin Green Card için yaptığı Statu Değişikliği (I-485) basvurusu reddedilmektedir. 

Gectiğimiz günlerde publıc charge standartlarına ve tanımlarıda yapılan değişiklikler sadece goçmenlik ofisi görevlilerin publıc charge tespitinde nelere odaklanması gerektiğini ve nasıl bir prosedür izlemesi gerektiğini belirlemek içindir, muaf statüler bu değişikliklerden etkilenmemektedir.
